These Terms of Service (“Terms”) govern your use of NexWorldTech's website, products and services. By signing up or using our services you agree to these Terms.

1. The service

We design, build, host and maintain websites for small businesses, and provide ongoing digital services including hosting, updates, reputation management and an AI front desk for instant call/text back and lead follow-up. Your website is built free of charge; our services are provided under a monthly subscription.

2. Subscription and billing

Our service is billed monthly at the rate shown on our pricing page (currently $257 per month, or as otherwise agreed in writing). You authorize us to charge your payment method on a recurring basis. Fees are non-refundable except as set out in our Refund Policy.

3. Free website offer

There is no upfront fee to launch your website. The website is provided as part of your active monthly subscription. If your subscription is cancelled, your website and related services may be removed or suspended.

4. Your responsibilities

• Provide accurate business information and content, and keep access credentials safe.
• Ensure you have the right to use any content, logos, images or trademarks you provide.
• Use our services lawfully and not for deceptive, harmful or unlawful purposes.

5. AI front desk and lead follow-up

Our AI reception feature answers calls, sends messages and follows up on leads using AI. You are responsible for how you use these features and for complying with applicable laws on calls, recordings, consent and marketing. AI responses may occasionally be imperfect; monitor them and configure prompts as needed.

6. Intellectual property

We retain ownership of our software, templates and tools. You retain ownership of your business content and website content you provide. Upon full payment, you may use the website we build for you for the duration of your subscription.

7. Cancellation and termination

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We may suspend or terminate service for non-payment, misuse, or breach of these Terms. On termination, you should export any content you need before your site is removed.

8. Disclaimer of warranties

Our services are provided “as is” and “as available.” We do not warrant that the services will be uninterrupted, error-free, or that they will achieve any particular business result. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of liability

To the maximum extent permitted by law, NexWorldTech shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to our services. Our total liability shall not exceed the amounts you paid us in the three months before the claim.

10. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes. Continued use of the service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws applicable to NexWorldTech's principal place of business, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
